Acceptable Use Policy for iManila Internet Hosting Services

The following Acceptable Use Policy (AUP) applies to all iManila Internet Hosting services clients.

These policies apply automatically to all iManila clients upon subscription to the Service/s including subscription through a third party or any commercial partner or reseller.

This AUP has been formulated with the following goals in mind:

· Ensure the security, reliability and privacy of iManila Systems and network and the systems and networks of others.

· Encourage the responsible use of Internet resources and discourage actions that will degrade the usability of network resources and the value of the Internet services.

· Avoid situations that may cause legal liability for iManila and its clients

· Maintain the good reputation of iManila as a responsible organization.

I. Legal

Client agrees to use the Service/s only for lawful purposes, in compliance with all applicable laws in the Philippines . Specific illegal activities that are prohibited include but are not limited to, the following:

1. Threatening acts or language to persons or property or otherwise harassing behavior.

2. Misrepresentation or fraudulent representation of products and/or services.

3. Transmission, distribution or storage of any material in violation of any applicable law or regulation (i.e., Pornography, Pirated materials, etc.).

4. Transmission, distribution or storage of any material protected by copyright, trademark, trade secret or other intellectual property right without proper authorization, and material that is obscene, defamatory, slanderous, an invasion of privacy or constitutes an illegal threat, or is otherwise illegal.

5. Facilitation, aid, or encouragement of any of the above activities, whether using iManila network or service by itself or via a third party’s network or service.

6. Interference with a third party’s use of iManila network or service, or ability to connect to the Internet or provide services to Internet users.

II. Email

iManila applies a strong anti-spam policy. This includes spamming through open proxy servers or any other kind of unsolicited email advertising. If Client is found to be in violation of our SPAM policy, iManila may, at its sole discretion, restrict, suspend or terminate client’s account. Furthermore, iManila reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. iManila will notify law enforcement officials if the violation is believed to be a criminal offense. Client acknowledges that he/she will be held responsible for any and all SPAM-related actions which come from their account. Specific EMAIL activities that are prohibited include, but are not limited to the following:

1. Sending of unsolicited email messages, including, without limitation, commercial advertising and informational announcements, is explicitly prohibited even if the lists are said to be opt-in.

2. Use of another site’s mail server to relay mail without the express permission of the site.

3. It is strictly forbidden to send out unsolicited email from any other network that advertises, promotes or in any way points to a location inside iManila network.

4. Maintaining an open SMTP relay is prohibited. Any direct action, configuration or setting that causes excessive outbound email traffic is subject to review and immediate suspension of account.

5. The email service has the following limits to assure overall server performance:

For Shared Hosting Services:

● 300 Email messages per domain per hour

● Email size is limited to 50MB via Webmail (includes the email body and attachments)

● Using Email Client applications. Email size limitation will vary from Email Client to Email Client. (Microsoft Outlook, Apple Mail, etc.)

For Dedicated Server Hosting Services:

● 500 Email messages per domain per hour

● Email size is limited to 50MB via Webmail (includes the email body and attachments)

● Using Email Client applications. Email size limitation will vary from Email Client to Email Client. (Microsoft Outlook, Apple Mail, etc.)

We reserve the right to refuse or terminate the Service/s of any known spammer. Also we reserve the right to solely determine who violates this policy on Spamming. Any violation may result in termination of the Service/s without refund.

 

III. Frequent Attack Target Services (IRC networks, Camfrog, etc.):

It is absolutely forbidden to host an IRC server that is part of or connected to another IRC network or server. Servers found to be connected to or part of these networks will be immediately removed from our network without notice. The server will not be reconnected to the network until such time that you agree to completely remove any and all traces of the IRC server, as well as provide us access to your server to confirm content deletion. It is also forbidden to host Camfrog servers or other server applications that are frequent targets of Denial of Service attacks or other types of attacks. Any server guilty of a second violation will result in immediate account termination.

 

IV. Adult content

It is strictly forbidden to publish adult content on our services. The restriction applies, without limitation, to images, videos and text.

 

V. System and Network Security

Client is prohibited from utilizing iManila services to compromise the security or tamper with system resources or accounts on computers at the Premises or at any third party site. Specific System and Network activities that are prohibited include, but are not limited to the following:

1. Threatening acts or language to persons or property or otherwise harassing behavior.

2. Use or distribution of tools designed for compromising security.

3. Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.

4. Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.

5. Deliberate attempts to overload a system and broadcast attacks.

6. Forgery of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

7. Intentional or negligent transmission of files containing a computer virus or corrupted data.

 

VI. Resource Usage

The Service/s is/are for corporate use. It is strictly forbidden to make your account resources available (whether for free or pay) to the general public. Without limitation, this applies to usage of an account to provide public online services like statistics, image hosting, free web hosting or any other similar service. At anytime, all hosting accounts must use an acceptable level of resources.

To keep the service stable and secured, limitations are set for each account on a shared server environment. This ensures the equally divided resources on the server and the smooth performance of all services.

All shared hosting plans are subject to the following limitations: no more than a) 25% of one CPU core; b) 768MB of RAM; c) 20 entry process; d) 100 active processes; e) 1 MB/s disk IO. In the event these limitations are exceeded, your site may slow down or not be served until more resources are added. More resources may be added for additional fees.

 

VII. Violation

iManila, in its sole discretion, will determine what action shall be taken in response to a violation on a case-by-case basis. Violation of this AUP could also subject Client to criminal or civil liability. iManila may block access at the router level to the Client’s Equipment involved. If iManila believes, in its sole discretion, that a violation of this AUP has occurred, such action may also include, but is not limited to, temporary or permanent blocking of access to Client’s Equipment or data, and the suspension or termination of Client’s services under this Agreement. iManila may involve, and if ordered by the courts, will also cooperate with law enforcement authorities in investigating suspected lawbreakers. iManila has no obligation to provide warnings under any circumstances, and can terminate the account without prior notice if the Client violates this policy.

 

VIII. Rights Reserve

iManila reserves the right to modify this AUP at any time without notice. Client is responsible for all use of the Service/s by itself, its employees, agents, contractors, invitees and clients, whether such use is with or without the consent of Client. iManila can require a signed copy of this document.
